Beyond the Bedside: Governance and Compliance Strategies for Compensating Non-Clinical Physician Roles
In this session Kathryn and Lindsey will give a speech discussing practical strategies, innovative models, and case-based insights to help counsel mitigate risk and support defensible, mission-aligned non-clinical compensation. Academic Medical Centers, teaching hospitals, and health systems increasingly rely on physicians to contribute to non-clinical roles such as research, teaching, quality improvement, and administrative leadership. While these contributions are essential to mission-driven care and academic advancement, they introduce complex legal and compliance challenges regarding compensation. Regulators continue to scrutinize non-productivity-based payments, particularly those lacking clear deliverables, time documentation, or governance oversight. Attorneys advising hospitals and physicians must be equipped to evaluate and defend these arrangements under the Stark Law, the Anti-Kickback Statute, and IRS inurement standards.
